Zaku Cebu Terms and Conditions

1. Account & Order Ownership
By creating an account on ZakuCebu.com, you are responsible for
 
• Maintaining the confidentiality of your Zaku Cebu account and password
• Restricting access to your Zaku Cebuaccount
• All activities that occur under your Zaku Cebu account and password
• Cancelling any open (unbilled) orders that you no longer wish to purchase
 
Customer accounts and orders on ZakuCebu.com are the sole property of the registered account holder, and are not to be sold, loaned, or otherwise transferred to another party or Zaku Cebu account. To do so will be grounds for the cancellation of all orders, and the closure or termination of their Zaku Cebu account (and any related Zaku Cebu accounts) without notice.
Zaku Cebu accounts are intended to be one per person. At our discretion, Zaku Cebu customer accounts may be limited to one per household.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders without notice.
 
2. Payment
The Philippine Peso price at the time you place an order is the price you will be charged. Due to international exchange rate fluctuations, prices in your preferred currency may change from the time you place an order to the time you are actually charged for it. The Philippine Peso price does not change.
If you pay by PayPal Billing Agreement in a limited currency, PayPal will handle the exchange to Philippine Peso. There may be a fee for this through PayPal or your credit card company. (Please see this chart to see if your preferred currency is limited.) Please consult with PayPal or your credit card company for details.

On rare occasions, at our discretion we may require prepayment for a high-value preorder item. If this is the case, we will contact you in advance.
 
3. Authorization to Charge the Customer
Placing an order through our web site is your permission to us to bill and deliver the items you order. We do not require any additional approval to charge your registered payment method prior to delivery, even if the final amount to be charged, including shipping costs, has not been confirmed with you. We will charge or bill you immediately for all in-stock items, which will then either be delivered based on your order handling method.
If two days pass from the time we first attempted to charge you, with no payment and no contact from you, that order and all of your open (unbilled) and billed but unpaid orders will be cancelled. Your Zaku Cebu account, and any related accounts, will also be disabled until you contact us again. If you are having a temporary payment problem, please contact us as quickly as possible to prevent these penalties.
 
4. Shipping Policies
When your order handling method is to ship via JRS, AP Cargo, Fedex, or UPS, we will process your order for shipping and charge you immediately for the merchandise and shipping costs for in-stock, on-site items.
There may be limits to the size of packages that can be shipped. These limits may be set by your country’s post office, or it may be physically impossible to ship many large items in one box. In such cases, your order may have to be shipped in more than one box. We reserve the right to ship your order in multiple packages if necessary.
A package’s delivery is complete when the package is delivered to the shipping address you provided for it in your Zaku Cebu account. Zaku Cebu is not responsible for anything that may happen to a package or its contents after it was delivered to the shipping address you provided. Any use of third-parties or reshippers is at the risk of the customer.
 
5. Product Availability
Items placed in the Shopping Cart are not held for you. An order is not placed until you complete the checkout process. Items only remain in the Shopping Cart for about 12 hours, and may be removed from the Shopping Cart as stock status changes. This will be reflected once you click “Checkout.”
After you place an order, backordered items will remain on order until you cancel them yourself, or we become convinced that an item will not be available for the foreseeable future and cancel it ourselves. You will be informed in an email from us if this happens.
Stock statuses advertised on third-party websites do not necessarily reflect the current stock status of an item. When conflicting stock statuses are shown between third-party websites and ZakuCebu.com, the ZakuCebu.com stock status takes precedence.
 
6. Returns
Requests for returns, for any reason, must be received within 7 days of delivery to be considered.
• Returns of Unwanted Items
Change of heart in wanting to get the item(s) when already en route or when shipped to you will not be tolerated. When using JRS, AP Cargo, Fedex, UPS, or Angkas Padala, consider all sales are final. Now if you’re still undecided on your desired item, there is still the meet up option to inspect your items before deciding in making a final purchase.
• Returns of Damaged or Defective Items
Damaged or defective items if shipped must be returned to JRS, AP Cargo, Fedex, UPS, or Angkas Padala to be inspected if it passes their respective terms. If these conditions are met, they will refund you the insured amount. Damage to product packaging or boxes are not considered product damage. They are only able to consider returns in cases of damage or defects of the actual merchandise itself.
No returns are possible if the item(s) were accepted via Meet Ups since you are responsible of inspecting the contents in person and in front of us prior to deciding in making the final purchase.
We also reserve the right to reject claims of manufacturing defects on items in cases of obvious user abuse.
• Packages Returned by JRS, AP Cargo, Fedex, or UPS
A package returned to us by JRS, AP Cargo, Fedex, or UPS as undeliverable or unclaimed, or a package refused by the addressee for any reason, is not an authorized return. As such, it may not be eligible for a refund of the cost of merchandise, at our discretion.
The cost of shipping will never be compensated in the case of a package returned to us by JRS, AP Cargo, Fedex, or UPS as undeliverable or unclaimed, or a package refused by the addressee for any reason.
If your package has incurred freight charges for its return to us, you are responsible for reimbursing us for those charges.
Returned international packages cannot be reshipped within the Philippines, and returned domestic packages cannot be reshipped internationally.
• Packages Returned by Angkas Padala
If Buyer fails to pay the rider, the option to reschedule with Angkas Padala is not available. Zaku Cebu will receive back the item(s) and we will be charged for it delivery fees. To reschedule in picking up the item, a meet up is to be agreed and Zaku Cebu has the right to be reimbursed by the buyer of the Angkas Padala delivery fee. If balance is settled, then we release the item(s) purchased.
 
7. Refunds
• Transactions made via Bank Transfer, Remittance, Paymaya, or Cash on Delivery
Please to Section 6 of this Terms and Conditions if regarding refunds due to Returns. If not due to returns, all sales are final when your item has been shipped or received.
• Transactions made via Paypal Express using your Debit/Credit Card or Paypal Account

Zaku Cebu does not cover any fees charged by your debit/credit card company or PayPal when processing refunds. All such fees are the sole responsibility of the customer.
Zaku Cebu is not able to provide any form of monetary compensation for orders that are cancelled without payment for any reason — including but not limited to manufacturer cancellations, shortage of stock, or delays in release dates.
 
8. Pre Order Cancellations
While we accept customers’ cancellations of all or part of their order at any time prior to billing, we ask that you keep cancellations to a minimum. Overstocks due to customer cancellations affect our ability to offer great prices, so this is in everybody’s best interest. Also take note, your pre order deposit is non-refundable.
Cancellations are permanent, and cancelled items or orders cannot be reinstated. Customers will need to place a new order for cancelled items they still wish to purchase. If cancelled items are no longer available, Zaku Cebu is unable to make them available again under any circumstance.
We reserve the right to limit or close the accounts of customers who abuse the cancellation policy, or abandon shippable orders without submitting payment.
Once a paid order enters shipping processing, it cannot be cancelled, but can be returned if damaged as described in our Section 6 above.
 
9. Payment Disputes & Chargebacks
Zaku Cebu is committed to customer service and will promptly address any customer claims as detailed in our Terms and Conditions. Because we’re committed to helping you, under no circumstances should you ever contact your credit card company or PayPal to dispute charges from Zaku Cebu.
We will solve all genuine customer service problems through possible refunds, reshipments, discounts or whatever else it takes to reach a fair solution to the problem. Although, we will need to hear from you if a problem has occurred.
Zaku Cebu vigorously contests any PayPal or credit card disputes or chargebacks filed by customers. Customers who have filed such disputes or chargebacks may be blacklisted from using our service, meaning we will accept no further orders from them.
 
10. System Manipulation
Any user found to be manipulating or attempting to manipulate any system feature or process, through any means of their own, third-party software, or any other method, may have their orders cancelled and their Zaku Cebu account locked or terminated without notice, at our sole discretion.
 
11. Product Descriptions
We always try to be as accurate as possible on our website. However, we do not warrant that product descriptions or other content of this site are accurate, complete, current, or error-free.
If a product offered by us is not as described, please contact us as soon as possible. If you have any questions about the nature of an item that are not addressed on our website, you are responsible for asking us before you purchase the item. If you have not asked us before purchasing and the item is not what you expected, the only solution is an authorized return as described above.
We reserve the right to remove or edit content without notice.
 
12. Sales & Promotions
If a campaign on ZakuCebu.com has rules that differ from these Terms & Conditions, the campaign’s rules will take precedence.
 
13. Revision Clause for this Terms and Conditions
We reserve the right to edit content of this Terms and Conditions due to any economical concerns that may arise without notice.

Zaku Cebu/Angkas Padala Delivery Terms and Conditions

As the great Orga Itsuka once said, we are to always move forward. With this forward thinking, Zaku Cebu​ has extended door to door delivery services to your home or to your work through Angkas Padala! Please take note though that to avail these services the following criteria has to be met and agreed upon:

1. Item(s) have to fully paid and cleared prior to delivery via Bank Transfer, Paymaya, Palawan Express, or Bitcoin before anything else.
2. Item(s) should not exceed over the P3,000 value since Angkas Padala’s insurance coverage doesn’t go beyond that.
3. Item(s) should not exceed the dimensions of 43cm x 38cm x24cm and will not weigh over 10kg. Unfortunately, oversized boxes like the bigger MG kits (i.e. Sazabi Ver Ka, The O) and PG Kits cannot be delivered with this option.
4. This delivery option can only be scheduled from 1:00PM to 10:00PM Monday to Saturdays except National Holidays.
5. Zaku Cebu is obligated to make sure item(s) are to be packed with care and inform the Angkas Padala rider that item(s) are fragile.
6. Buyer is to meet Angkas Padala’s rider at the given shipping address that was agreed when item was purchased via Facebook’s PM conversation or via SMS text.
7. Buyer is to pay Angkas Padala’s delivery fees on top of the cost of the item. Flag down price in Cebu starts at P20. P15/km for the first 8 km, and P20/km beyond that.
8. If Buyer fails to pay the rider, the option to reschedule with Angkas Padala is not available. Zaku Cebu will receive back the item(s) and we will be charged for it delivery fees. To reschedule in picking up the item, a meet up is to be agreed and Zaku Cebu has the right to be reimbursed by the buyer of the Angkas Padala delivery fee. If balance is settled, then we release the item(s) purchased.
9. In a situation where the buyer inspects the package to be damaged (meaning the kit inside are broken), contact Angkas Padala’s customer service at (0906) 511-1101 or through their local Facebook Fan Page to initiate insurance. Zaku Cebu will assist as much as they can, but will not be held liable for any damages.
10. Not reading or not knowing about this disclaimer is not an excuse if anything goes sour during the delivery. Change of heart in wanting to get the item(s) when already en route to you will not be tolerated. When using this delivery option, consider all sales are final. Now if you’re still undecided, there is still the meet up option to attain your items.
